    Felon murders elderly woman day after getting out of jail, police say

    COCOA, Fla. - Less than 24 hours after Marcus Royal was released from jail, police say he burglarized an elderly woman's home, murdered her, and nearly killed her neighbor.

    Marcus Royal had a big smile on his face as he was booked into the Brevard County jail Wednesday night on a charge of first degree murder and attempted murder. The 33-year old was still smiling when he appeared before a judge for his arraignment on Thursday afternoon.

    An arrest document released Thursday afternoon states that the Royal is facing charges which could ultimately cost him his life.

    Police said he bound and gagged 81-year-old Faye Jones with duct tape, and brutally beat her to death on March 17 at her home on Fiske Boulevard in Cocoa. Her neighbor, who has not been identified, also suffered a head injury and is in critical condition at a local hospital.

    Police said the convict took the elderly victim's purse and phone after he broke into her home, and then drove out of state. But he turned himself in to Virginia authorities after his image was captured at an ATM while withdrawing money from the Faye's account. Police said he racked up close to a thousand dollars of charges.

    Assistant State Attorney Gary Beatty said that, if Royal is convicted, he would be eligible for the death penalty.

    "The fact that the victim is elderly is a fact that courts can take into consideration when determining aggravating factors for the death penalty."

    Royal was released on March 16 from the Brevard County Jail after serving a prison sentence for robbery and sexual battery. Royal is now being held in the jail without bond.

    Royal is also charged with killing Ann Mull, another elderly woman who lived in nearby Rockledge. Just last month he was found guilty for probation violation that stemmed from several sexual battery convictions from 1993.

    Inmate charged in central Fla. woman's 2011 death


    ROCKLEDGE, Fla. — An inmate who was already in jail awaiting trial on another case is now charged with the 2011 murder of a 73-year-old woman.

    A grand jury in Brevard County indicted Marcus Royal, 34, on Tuesday in the death of Ann Marie Mull. She was found dead inside her Rockledge home in May 2011. The death was initially thought to be from natural causes.

    Florida Today reports that several weeks after Mull’s death, the executor of her estate noticed activity on her credit cards. Her daughter, Melis Mull, also noted that she discovered her mother’s purse missing as she was cleaning out the house.

    Royal, who has spent more than half his life behind bars, is awaiting trial in the March killing of 80-year-old Ethalya “Faye” Jones.

    Melis Mull said her mother’s boyfriend was the first to notice something wrong in May 2011. He got worried when Ann Mull didn’t answer her phone. So he called neighbors with a spare key and asked them to check on her. They found her body, dressed only in underwear.

    The medical examiner ruled Ann Mull died of a heart attack.

    “It was not immediately known, or initially known to be a homicide,” said Assistant State Attorney Michael Hunt. “It was not investigated initially as such.”

    Royal is accused of first-degree felony murder, burglary of a dwelling with an assault or battery, grand theft and fraudulent use of a credit card.

    Melis Mull said the indictment is bittersweet.

    “It’s like a big relief, but it still sucks,” she said.

    Victim in 2013 Cocoa home attack dies; police seek new charges

    COCOA (AP) -- Police now say additional murder charges are possible against a man accused of brutally killing an elderly woman last year. A family friend who tried to help and was also viciously attacked has now died, and loved ones are speaking out about the ordeal.

    Michael Fallon's sister and brother still can't believe he's gone.

    "I miss him so much. I loved him so much. But he's at peace and up there with the Lord," said Fallon's sister Debbie Pierzynski.

    Marcus Royal, 33, is charged with first degree murder in the death of Faye Jones, 80.

    Investigators said while Royal was brutally attacking her in her home, Fallon, 55, went to check on her. He had no idea someone else was in the home.

    "That man doesn't deserve to be on this Earth," said Fallon's brother Gary, speaking of Royal.

    They said Royal also attacked Fallon. He then stole Jones' purse and cell phone and fled the state. Royal later turned himself in to authorities in Virginia.

    Jones died, but Fallon survived. He made it through a coma, grueling physical therapy and rehab for a year and half. He just passing away last week when his family took him off life support. Both families say they never told Michael what had happened to him and Faye Jones.

    "This should have never happened to you, to Faye," says his sister.

    Cocoa Police are awaiting results from the medical examiner to pursue additional murder charges against Royal, who is sitting in jail awaiting trial for Jones' murder.

    Royal is also charged with killing Ann Mull, another elderly woman who lived in nearby Rockledge. Just last month he was found guilty for probation violation that stemmed from several sexual battery convictions from 1993.

    Man faces third first-degree murder charge in Brevard home invasion cases

    COCOA, Fla. — A Brevard County man is facing his third first-degree murder charge stemming from an alleged home invasion and killing in 2013.

    Marcus Antonio Royal, 34, was already charged with first-degree murder for the killing of Faye Jones, 80, in March 2013.

    Royal allegedly broke into Jones' home, killed her then attacked Michael Fallon, 55, when he came to the home to pick up Jones for church.

    "They were church buddies, they were Bible-study buddies," said Cocoa police spokeswoman Barbara Matthews. "Mr. Fallon really watched out for Mrs. Jones."

    Fallon was hospitalized following the attack and died from his injuries on Aug. 9.


    A Brevard County grand jury returned the third indictment after hearing testimony from the Brevard County Medical Examiner, a Brevard County Sheriff's Office crime scene investigator and a Cocoa Police Department detective.

    Defense Lawyers Request Speedy Trial For Cocoa Man Accused of Double Murder

    BREVARD COUNTY, FLORIDA (WFTV) – The attorneys for an accused Brevard County killer are asking the court to grant him a speedy trial.

    Marcus Royal is already serving a life sentence for violation of probation in another case.

    Prosecutors want him on death row for the 2013 murder of Faye Jones and her neighbor, Michael Fallon. Fallon was injured in the attack, but later died.

    Channel 9’s Melonie Holt was in court Monday when Judge James Earp said it was time to move the case forward. However, the judge also pointed out that the death penalty is under question statewide.

    Prosecutors reiterated Monday that they believe that the death penalty is still on the table for Royal.

    Royal is accused of tying, binding and brutally attacking 80-year-old Jones in her Cocoa home.

    VIERA, Fla - The death penalty will be in play in the upcoming trial of a Brevard County convicted felon.

    That was the ruling Friday from a county judge hearing prosecution and defense arguments in the double-murder case of 34-year-old Marcus Royal.

    Royal is accused of murdering 81-year-old Faye Jones and 55-year-old Michael Fallon in 2013.

    Prosecutors say Royal stabbed Jones to death inside her Cocoa home and then fatally attacked Fallon, who was her neighbor.

    Royal is already serving life for violating his probation from a 1993 rape case.

    Friday, his defense team requested from a judge a speedy trial for their client without the possibility of a death sentence.

    While the judge agreed to start trial in February, he dismissed the notion that the death penalty should be off the table.
    "The death penalty as a penalty is a constitutional penalty," said Judge Jim Earp.

    The state Supreme Court says Florida's death penalty law, requiring a unanimous decision from a jury to send someone to death row, is constitutional.

    Judge Earp accepted that in Friday's hearing.

    "We're talking about something that's completely procedural," said the judge.

    The defense wanted Royal to face life in prison without parole.

    Prosecutors, on the other hand, said they're satisfied to now be building a case calling for death.

    "Our role in this is to show them what happened and the circumstances and character issues that he has and then ask a jury is life enough in this case or is this so bad he should be executed," state attorney Bill Respess told News 6 following the hearing.

    Cocoa double murder case can proceed as death penalty trial

    The death penalty for Marcus Royal is still on the table, even though the U.S. Supreme Court ruled Florida's death penalty process unconstitutional a year ago.

    Royal made a court appearance Tuesday. He's accused of killing 80-year-old Faye Jones and 58-year-old Michael Fallon.

    Prosecutors say Royal brutally attacked the elderly woman inside her Cocoa home March 17, 2013, then turned on Fallon as he arrived at the house to take her to church that day.

    Fallon survived in a coma for a year and a half until his family chose to take him off life support.

    Royal was on the run shortly after the crimes, eventually turning himself in to authorities in Virginia.

    Despite the uncertainty of the state's death penalty process, Judge Jim Earp ruled last week that the state can continue preparing for a death penalty case. Earp also granted the defense's motion for a speedy trial.

    But Tuesday, the defense changed its mind, asking for a continuance.

    That didn't sit well with the judge, who called their actions a "sham."

    "I am not continuing this case. I am giving Mr. Royal the speedy trial he asked for, thank you. This hearing is over," Earp said.

    Both the defense and prosecution will have to prepare as though this were a death penalty case.

    Jury selection begins Monday.

    Accused killer wants his recorded confession thrown out

    BREVARD COUNTY, Fla. — A man is accused of randomly killing elderly women, and he is apparently confessing to it.

    Now, more than six years after the most recent death, that man wants his recorded confession thrown out.

    That recording was played in court on Monday with the defendant yet to stand trial.

    Prosecutors say Marcus Royal has hurt or killed many people.

    Faye Jones, 80, was stabbed at random in 2013 while she was getting ready for church in her Cocoa home.

    Eva Marie Mull, 73, was targeted at random and stomped to death in her Rockledge home in 2011.

    Michael Fallon took a year and a half to die from the beating he received as he stumbled in on the Faye Jones murder, officials said.

    In court on Monday, prosecutors played a recording that police made while interviewing Royal after his 2013 arrest.

    It's an incriminating piece of evidence, and Royal's defense attorney wants it thrown out.

    She would not talk to WESH 2 News on Monday.

    It's one of countless maneuvers Royal's defense has made that's kept him from trial.

    A previous judge had ordered a trial in 2017, but it never happened.

    Royal's mother was in court on Monday.

    "You look at him. He's strong, he's handsome. I wish I could have him in my life. I need him. I'm a disabled woman," Eva Barnett, the suspect's mother, said.

    No trial date has been set at this time.
