    An attorney hired by Eric Frein's (freen) family to represent the ambush suspect the night of his capture said Monday that police prevented him from seeing Frein and refused to tell his client a lawyer was available.

    James Swetz is a veteran criminal defense attorney from Stroudsburg.

    Police interviewed Frein at the barracks after his Oct. 30 capture. Authorities have not revealed what he told them.

    His public defenders could try to get any confession Frein made to police that night ruled inadmissible at trial, though U.S. and Pennsylvania Supreme Court decisions could make that difficult.

    Frein is charged with opening fire outside the Blooming Grove barracks on Sept. 12, killing Cpl. Bryon Dickson and seriously wounding Trooper Alex Douglass.

    Alex Douglass, trooper allegedly wounded by Eric Frein, transferred to new hospital

    A Pennsylvania state police trooper who was shot and wounded by a sniper two months ago has been taken to a hospital in New York City.

    The Times-Tribune of Scranton reports
    that an ambulance transported Trooper Alex Douglass to the Hospital for Special Surgery on Monday night.

    State police Lt. Christopher Paris declined to provide specifics on why Douglass was taken to the hospital but says it wasn't an emergency. The hospital specializes in orthopedics.

    The Sept. 12 ambush outside the Blooming Grove barracks killed Cpl. Bryon Dickson and seriously wounded Douglass, who was shot in the pelvis. He spent more than a month in the hospital before being transferred to a rehabilitation center.

    The suspect, Eric Frein, was captured Oct. 30 following a 48-day manhunt.

    Charges Against Alleged Cop Killer Eric Frein

    Alleged Pennsylvania cop killer Eric Frein was charged with two additional counts of terrorism after investigators found a letter to his parents declaring that only "another revolution can get us back to the liberties we once had."

    Frein, 31, is charged with murdering state police Cpl. Bryon Dickson and wounding Trooper Alex Douglass in a Sept. 12 ambush on a Pennsylvania State Police barracks. A preliminary hearing had originally been scheduled for Dec. 9, but the new counts were entered Thursday in an unexpected hearing in Pike County Magisterial District Court.

    The new charges — terrorism to influence the policy of government by intimidation or coercion and terrorism to affect the conduct of a government — carry maximum sentences of 40 years in prison.

    "Tension is high at the moment and the time seems right for a spark to ignite a fire in the hearts of men," says the letter investigators said they found on the hard drive of a computer . "What I have done has not been done before and it felt like it was worth a try."

    The letter's writer goes on to complain: "There is so much wrong and on so many levels [that] only passing through the crucible for another revolution can get us back to the liberties we once had. I do not pretend to know what the revolution will look like or even if it would be successful."

    Prosecutors have said they plan to seek the death penalty. While Frein, a self-styled survivalist and military buff, allegedly left behind a letter recounting how he picked off the two officers with rifle fire and then fled into the woods.

    A count of attempted homicide was dropped in the amended complaint. The Pocono Record newspaper reported Thursday that an attorney for Frein's family complained that he'd been denied access to Frein shortly after his arrest. The lawyer, James Swetz, told the newspaper that Frein could make a reasonable argument to strike his statements to police because they were made without counsel present. It couldn't be determined whether that argument was related to the new complaint.

    Eric Frein to parents: 'I do not have a death wish but I know the odds'

    Authorities in Pennsylvania on Thursday released[/URL] a letter they said was written by state police ambush suspect Eric Frein during his time on the run. The text, addressed to Mom and Dad, reads:

    Our nation is far from what it was and what it should be. I have seen so many depressing changes made in my time that I cannot imagine what it must be like for you. There is so much wrong and on so many levels only passing through the crucible of another revolution can get us back the liberties we once had. I do not pretend to know what that revolution will look like or even if it would be successful.

    Tension is high at the moment and the time seems right for a spark to ignite a fire in the hearts of men. What I have done has not been done before and it felt like it was worth a try.

    If I am dead I would like to be buried in a wood casket (no lead lined casket!) so that my remains can return to where they came from. I realize that this may not be possible though, laws and what not, so don't sweat it. Also, light a candle for me at the Russian or Greek Orthodox church in Stroudsburg from time to time. It doesn't need to be during a liturgy, just whenever they are open. I am sure you can figure it out.

    I do not have a death wish but I know the odds. I tried my best to do this thing without getting identified, but if you are reading this then I was not successful. If I am still alive and free know that I will do my best to remain as such. And as time goes by, if circumstances change, if my spark hit good tinder, then I may be able to return one day.

    I am sorry. You guys are great parents, I am just not a good son. I squandered so much opportunity and support and rarely tried my best at anything. God knows I do not deserve the things I had, maybe He knew I would be sacrificing all of it in the end, or maybe this is just the final squander. Who knows.

    I love you. Please forgive me of my many faults. And thanks for putting up with me for so long.

    Eric Frein's capture came with $11 million price tag including $6.9 million in overtime pay for state police

    Catching Eric Frein was a top priority for state police, so much so that $11 million was spent to catch the suspect, according to information released by Pennsylvania State police.



    Frein's capture cost $10.5 million in personnel expenses for salary and benefits for Police employees. Overtime pay alone was a $6.9 million dollar expenditure, with $2.8 million going to benefits, both above officers normal pay. The total did not include costs for outside agencies costs incurred to help in the search.

    Frein is accused of killing a state trooper and seriously injuring another in a shooting Sept. 12 at the Blooming Grove Township barracks in Pike County.

    Frein's preliminary hearing was scheduled for Dec. 9, but Frein was also charged with terrorism Nov. 13. No date has been set.

    Computers, phones key in Eric Frein prosecution

    Eric Frein may consider himself a frontier survivalist who can live off the land, but newly unsealed search warrants show that the case against him relies heavily on technology.

    The warrants, issued early in the manhunt and made public last week, show that police removed data from computers and memory cards found in Frein's home, and also searched the phone of Justin Smith, an East Stroudsburg man who described himself to The Morning Call as Frein's "only friend."

    Police say Frein stayed at Smith's apartment on Sept. 11, one day before he allegedly gunned down two state troopers at the Blooming Grove barracks in Pike County. Police say Frein cut his hair into a mohawk, as part of mental preparation for the shooting, in Smith's bathroom.

    On the night of Sept. 12, police say, Frein sent Smith a text message: "All is good."

    Smith has not been implicated in the killings or accused of helping Frein.

    The warrants don't say what information was gleaned from the seized devices, which include two Apple iPhones, an iPad, two Lenova ThinkPads and several computer hard drives and memory cards. But a warrant request shows that investigators were looking for clues into Frein's Internet activity and passwords.

    Previous court filings show that Frein searched the terms "can police track cell phones" and "how to escape a manhunt." He also looked for a "ballistics trajectory calculator" and information on "caching food," according to court records.

    Pike County District Attorney Ray Tonkin said Friday that there is a "variety" of evidence against Frein, including information found on electronic devices. He declined to elaborate.

    Tonkin also declined to say if Smith will be called as a witness at Frein's preliminary hearing, which is set for December 9.

    Frein, 31, of Canadensis, is accused of killing State Police Corporal Bryon Dickson and seriously injuring trooper Alex Douglass in the ambush-style attack. He then led police on a 48-day manhunt, before being apprehended by U.S. marshals at an abandoned airplane hangar near the Birchwood Resort in Pocono Township, about 30 miles from the shooting scene.

    He's charged with murder of a law enforcement officer, terrorism and numerous other crimes. Prosecutors are seeking the death penalty.

    In a letter he allegedly wrote to his parents, Frein said that he committed the crime in an effort to spark a change in the government.

    "Tension is high at the moment and the time seems right for a spark to ignite a fire in the hearts of men," he allegedly wrote.

    Frein is being held without bail in the Pike County prison. Frein's public defenders, Michael Weinstein and Robert Bernathy, were not available for comment Friday.

    Preliminary hearing for Eric Frein postponed until Jan. 2015

    A Pike County judge has again postponed the preliminary hearing for Eric Matthew Frein.

    Magistrate Judge Shannon Muir granted a defense request for a continuance in Frein's case Friday afternoon. The hearing has been moved to 9 a.m. on Jan. 5 in Pike County Court.

    Frein is charged in the homicide of a state trooper and serious injury of another trooper in a shooting Sept. 12 at the Blooming Grove Township state police barracks in Pike County.

    This is the second time the hearing has been pushed back. Defense attorneys previously requested the hearing be moved from Nov. 12 to Dec. 9.

    Frein's attorney, Michael Weinstein, requested the continuance after co-counsel Robert Bernathy was withdrawn from the case as of Dec. 5, according to court documents.

    Bernathy petitioned to be withdrawn because it would limit him from doing his job as a part-time public defender for Pike County. He also cited potential personal and professional conflicts of interest, among his reasons.

    Pike County District Attorney Raymond Tonkin wrote that he opposed the continuance because a witness from Louisiana was scheduled for the Dec. 9 hearing, Weinstein is still representing Frein and no reason exists to move the hearing.

    Eric Frein's lawyer withdraws from case; preliminary hearing rescheduled

    MILFORD, Pa. (AP) — A preliminary hearing for the man charged in the fatal ambush of a Pennsylvania State Police trooper was rescheduled Friday after one of his lawyers withdrew from the case.

    A judge granted a defense request to move Eric Frein's hearing to Jan. 5. It had been scheduled for Tuesday. The judge will decide at the hearing whether Frein should stand trial in the Sept. 12 slaying of Cpl. Bryon Dickson and wounding of a second trooper.

    Defense attorney Michael Weinstein asked for the postponement after his co-counsel, Robert Bernathy, withdrew from the case, citing potential "professional and personal conflicts of interest" and his responsibilities as Pike County's chief public defender.

    Weinstein said a new lawyer will need time to get up to speed.

    The Pike County prosecutor opposed the delay, saying Weinstein had been on the case since shortly after Frein's arrest. District Attorney Ray Tonkin also noted that a witness from Louisiana was set to appear Tuesday.

    Frein, 31, is charged with firing on the Blooming Grove barracks, killing Dickson and seriously wounding Trooper Alex Douglass. Frein led police on a 48-day manhunt after the attack in the Pocono Mountains.

    Prosecutors are seeking the death penalty.

    Bernathy couldn't be reached at his office after hours Friday to answer questions about his withdrawal.

    "I'm really going to miss him. He's a very fine lawyer and really important to our team," Weinstein said.

    Weinstein has petitioned to have another lawyer, William Ruzzo, added to the defense team.

    Alleged cop killer Eric Frein's hearing draws crowd of media, public in Pike County

    The media frenzy that followed the search, capture and initial court appearance of alleged cop killer Eric Frein returned early Monday morning to the small Pike County community of Milford, Pennsylvania.

    Frein last drew a crowd Oct. 31 when he was arraigned on murder and related charges involving the killing of Pennsylvania State Police Cpl. Bryon Dickson and wounding of Trooper Alex Douglass on Sept. 12 outside the Blooming Grove Township barracks.

    Frein was captured Oct. 30 by U.S. marshals in an abandoned airport hangar in Monroe County.

    Members of the public mixed with media personnel lining up outside the brick courthouse. It appeared there were fewer television trucks than during the late October hearing, but there was still a significant presence.

    A number of people were escorted by police into the courthouse. Frein was in the courthouse well before the doors were opened.

    A sign on a building near the rear of the courthouse read, "Pa. State Police, honoring those who serve."

    The 9 a.m. hearing in front of District Judge Shannon L. Muir will determine if there is enough evidence to try Frein in county court.

    Alleged cop killer Eric Frein's capture a peaceful end to violence, plans for revolution, testimony reveals

    When U.S. Marshals first spotted Eric Frein, 48 days into the manhunt that paralyzed residents living in the Pocono Mountains, he was alone, clad in black and walking across an empty field.

    Deputy John Schaaf said it was one of the other men he was with who first caught sight of the 31-year-old wanted in the Sept. 12 murder of Cpl. Bryon Dickson and attacks on other law enforcement officers, including wounded Trooper Alex Douglass at the Blooming Grove state police barracks.

    It was the day before Halloween, a holiday many expected would be canceled since the alleged killer was on the loose.

    "Scott said there's a man in black walking through that field," Schaaf recalled as he took the stand at Frein's preliminary hearing Monday in Milford.

    Schaaf and the two other men he was with were scouring buildings at an abandoned resort in Pocono Township when they saw Frein and – Schaaf said – when Frein saw them.

    "I know he saw me. I think he saw Scott first," said Schaaf. "But I know he saw me."

    Frein was ordered to put his hands up. He did. He was told to get to the ground. He did that, too, said Schaaf.

    "What's your name?" Schaaf's colleague called out.

    "Eric Frein," the defendant allegedly answered.

    And just like that, the man who kept multiple Pennsylvania counties on edge for more than a month was under arrest.

    Homicide, terrorism and other charges inch toward trial

    Every one of the charges facing Frein – which include among many others homicide, attempted homicide, possession of weapons of mass destruction, and terrorism – were bound to county court after the hearing that stretched beyond five hours at the Pike County Courthouse in Milford, Pennsylvania.

    District Judge Shannon L. Muir said she saw enough evidence presented in the exhaustive preliminary hearing to allow the case to move to trial. District Attorney Ray Tonkin, who's prosecuting the case, said he intends to pursue the death penalty against Frein. Defense attorney Michael Weinstein said he wasn't surprised by anything presented Monday and on several occasions interrupted the proceedings to allow evidence to be entered without exhaustive questioning by the prosecution.

    The packed courtroom, filled with media, family and curious citizens, listened to investigators and experts, watched video surveillance footage and viewed photo after photo of shell casings, broken glass, weapons and letters.

    Frein, for his part, was quiet – avoiding the steady gazes of the audience each time he was escorted to his seat. Clean-shaven and his face clear of the bruises that marred it during his Oct. 31 arraignment, Frein wore a dark blue prison jumpsuit and shackles that gave away his every move in court with the clinking of chains.

    Prodded by a reporter to explain himself as he was led from the courthouse, Frein, shuffling toward a squad car, said nothing.

    "It's your last chance, Eric!" the reporter hollered.

    A state trooper helped the silent Frein duck his head into the car before he disappeared from view.

    Frein helped authorities find guns so kids would not

    Despite the bravado and talk of revolution revealed in Frein's writings, the Barrett Township man was about as rowdy on the night of his capture as he was during his hearing today, according to testimony.

    Schaaf said Frein didn't flee when he was cornered by U.S. Marshals. But Schaaf said Frein's cooperation may have been motivated more by his being outnumbered than by his desire to surrender.

    "He was gauging – I mean, in my experience and training, it seemed he was looking around to see how many there were of us and what we were doing," Schaaf said.

    Frein was handcuffed as he lay on his belly, his face pressed into the tarmac, according to testimony. Schaaf said it was likely there that Frein suffered the cuts to his face that were so prominently on display during his arraignment.

    Schaaf said he worried that a strange object found under Frein's clothes was an explosive device – it turned out it was just suspenders holding up a second pair of pants on the self-styled survivalist.

    Frein told them he had a pocketknife and indeed, Schaaf said, that was the only weapon authorities recovered on him. The alleged killer told authorities about the weapons at his camp, Schaaf said. He told them there were no explosives, but they would find plenty of ammunition, according to testimony.

    Schaaf said Frein also wanted them to know about a loaded handgun inside the hangar.

    "I want to tell you this to make sure you guys find it because I don't want a kid to find the gun," Schaaf said Frein told him.

    Video shows last minutes of Cpl. Dickson's life


    Frein's concern that a youngster might stumble on his firearm was strangely juxtaposed with the stirring video shown in court earlier Monday. On the grainy, halting security cameras, the horror of that late night on Sept. 12 played out in silence.

    State police Cpl. Warren Grabher testified about three surveillance cameras that captured the final minutes of Dickson's life, shown on a large projection screen near the judge.


    The three cameras provided simultaneous views of the lobby and the area just behind as Frein allegedly fires at the men from a considerable distance. Frein, who authorities say was hunkered down in a wooded area across the parking lot, was never pictured in the footage.

    With his shift over, Dickson is seen just before 11 o'clock heading from the secure part of the barracks into the lobby, which leads to the outside. He pauses for a second or two before heading out of frame. He's captured in a glimpse, then a figure falls to the ground. Grabher testified that the falling figure was Dickson. Next, a woman identified as state police Police Communication Officer Nicole Palmer can be seen running from the secure part of the building and she talks to Dickson as she crouches in the doorway, though the corporal isn't visible in the frame.

    Palmer suddenly returns to the lobby and is banging on the windows to the secure area, trying to get troopers' attention.

    At the same time, Trooper Alex Douglass' shadow moves toward the barracks where Dickson lies before he's seen pulling himself to safety inside the lobby.

    Douglass drags himself on his belly, his legs motionless behind him. He gets a short distance, pauses, looks down and then pulls himself forward again with grim determination. Douglass had been arriving for his shift.

    A trooper opens the secure doors from the barracks to the lobby; another trooper drags Douglass beyond those doors as shots continue to be fired, Grabher said.

    "Cpl. Dickson is still lying out front on the sidewalk there," Grabher said, pausing slightly each time he mentioned the corporal's name.

    One of the troopers who aided Douglass next points a weapon toward the parking lot, according to the lobby camera. He provides cover for another trooper, who was carrying a shield as he exits the lobby. That trooper secures a patrol car from the parking lot and drives it to the front of the barracks to protect Dickson's body, Grabher said.

    Once the car is parked, three other troopers run out of the lobby and drag Dickson's body into the building; one had the corporal by the legs and the other two troopers had each arm. Dickson wasn't moving as he was carried.

    There was a collective gasp from the gallery as Dickson's image was projected on the large screen before he dragged back out of frame. Pike County Coroner Kevin Stroyan testified that he arrived at the barracks where he pronounced Dickson dead in the hallway of the station.

    Explosives, weapons and writings found at campsites


    Authorities testified to finding improvised explosive devices, or IEDs, at a campsite belonging to Frein just off Laurel Run Road. A checkbook with Frein's name and some trash – which included three torn and soiled notebook pages describing the night of the ambush and killing – were found at that first site.

    "Lots of cops on 402," Frein allegedly scribbled on the papers after the shooting. "No attention given to the woods. Spent all night traveling SW."

    Investigators said the explosives lead authorities to suspect Frein had the capabilities to inflict more harm. In the hangar, authorities said they found two long guns and a loaded handgun – as Frein described in Schaaf's testimony.

    A letter to his parents, found in the hangar and last accessed by his laptop on Oct. 6, said that only by "passing through the crucible of revolution" could the nation return to its former glory.

    "What I've done had not been done before and it felt like it was right," he wrote. "I do not have a death wish, but I know the odds."

    Frein said he hoped his actions would incite a revolution that would change the country. If so, he said, he might be able to return home alive.

    "If my spark hit good tinder, I'll be able to return one day," Frein wrote. "You are great parents. I am just not a good son. Please forgive my many faults and thanks for putting up with for this long."
