Triple homicide suspect captured in Selma

SELMA, AL (WSFA) - Lowndes County triple homicide suspect Deandra Marquis Lee has been captured in Selma according to the Selma Police Department.

Lee was captured just after 11 a.m. at the Merrimac Apartment Complex on Medical Center Parkway. Authorities say Lee did not attempt to resist arrest.

Selma Police say a concerned citizen called Selma Police Chief William Riley, who, in turn, notified the ABI and the U.S. Marshals. Witnesses say within minutes at least a dozen SWAT team members surrounded the apartment complex off of Hwy. 80.

Agents made their move at 11 a.m. using a neighbor's apartment to help map out where Lee might be inside the building. Agents broke down the door and threw in a "flashbang" surprising Lee to the point that he put up no resistance.

Both Lee and the female he was staying with in that apartment were apprehended. That woman was also taken in to custody but it's not clear at this point who she is or if she'll face any charges.

Lee was wanted for the deaths of 9-year-old twins Jordan and Taylor DeJerinett and their 73-year-old caretaker Jack Mac Girdner. The victims' bodies were discovered Tuesday dumped along Alabama Highway 21. They were believed to have been taken from the Lake Ridge Road area of Hope Hull. Authorities confirm that all three sustained gunshot wounds.

Girdner's 1988 Mercedes Benz was also listed missing at the same time as the victims. It was discovered in the Minter Community of Dallas County with all four doors removed.

A total of $10,000 in rewards were offered for the information leading to the capture and conviction of Lee.

Lee was immediately taken from Selma to ABI headquarters in Montgomery. Following interrogation he will be taken to Lowndes County.

The funeral for Jordan and Taylor DeJerinett has been scheduled for Monday at 1 p.m. at the Freewill Missionary Baptist Church in Montgomery.

The ABI released this statement at 5 p.m. regarding Lee's arrest:

The Alabama Bureau of Investigation, a division of the Alabama Department of Public Safety, announces that Deandra Marquis Lee, 22, was arrested for murder at approximately 11 a.m. today in Selma.

ABI Chief Neil Tew credited the capture of this fugitive to a cooperative effort of numerous law enforcement agencies. Tew went on to acknowledge significant assistance from the U.S. Marshals Service Gulf Coast Regional Fugitive Task Force, Lowndes County Sheriff's Department, Lowndes County District Attorney's Office, Selma Police Department, Dallas County Sheriff's Department and Montgomery Police Department.

Through investigative leads, tips from the public and collaborative resource sharing among law enforcement partners, credible information was developed leading to Lee's location, an apartment complex near Vaughn Medical Center in Selma. Earlier today, law enforcement officers converged on the scene and evacuated residents in the respective apartment building. Authorities attempted to initiate communication with occupants of the apartment without success.

After an Alabama State Trooper tactical team made entry into the apartment, the team immediately took Lee into custody. He then was transported to ABI Headquarters in Montgomery. Lee is charged with three counts of murder in the deaths of 9-year-old twins Jordan and Taylor Dejerinett of Montgomery and their 73-year-old caregiver, Jack Mac Girdner of Hope Hull.

Col. Hugh B. McCall, the director of the Alabama Department of Public Safety, said this arrest sends a clear and strong message: "Alabama -- both law enforcement agencies and the public -- will not tolerate such heinous crimes in our society. We will pursue tirelessly until capture."

Man mentally competent to stand trial in murders of 9-year-old twins, elderly caretaker

HAYNEVILLE, Alabama -- A Lowndes County judge has ruled a man is mentally competent to stand trial on capital murder charges stemming from the slaying of 9-year-old twins and their caretaker.

Circuit Judge Terri Bozeman Lovell ruled that a psychological examination showed Deandra Marquis Lee is capable of helping his attorney with his defense.

Lee is scheduled for trial April 6 in Hayneville on charges accusing him of the shooting deaths of 9-year twins Jordan and Taylor Dejerinett of Montgomery and their 73-year-old caretaker Jack Mac Girdner of Hope Hull in June 2012. Their bodies were found along Alabama Highway 21 in Lowndes County.

    Lee has pleaded not guilty.

Lowndes Co. triple homicide suspect Deandra Lee seeks to block death penalty

LOWNDES CO., AL (WSFA) - Attorneys for Lowndes County triple-murder suspect Deandre Lee have filed court motions seeking to bar the death penalty from being applied in his upcoming trial. Court filings show Lee's legal counsel is seeking to block it on grounds that it's unconstitutional.

Alabama statute currently requires a judge, not a jury, to make the ultimate findings that are necessary to order the death sentence.

"For these reasons, Deandra Lee respectfully requests that this Court bar imposition of the death penalty in Mr. Lee's case and declare that life without the possibility of parole is the maximum sentence available," Lee's attorneys wrote, adding, "Alabama's death penalty scheme is clearly as unconstitutional as Florida’s under the Hurst ruling."

The Hurst ruling refers to Timothy Hurst, convicted of murder in Florida and sentenced to death. His case made its way to the U.S. Supreme Court which in an 8-1 ruling declared Florida's death sentencing unconstitutional because a judge is required to be the final arbiter rather than a jury.

Lee is accused of killing 9-year-old twins Jordan and Taylor DeJerinett, along with their 73-year-old caretaker, Jack Mac Girdner, back in June 2012. Their bodies were found dumped along Alabama Highway 21. Each had been shot to death. Girdner's automobile was later found without its four doors.

Lee was arrested in Selma several days later and charged with the deaths. He pleaded not guilty in August 2013.

In addition to the sentencing issue, the defense is also seeking to delay Lee's trial again. It's been pushed back multiple times since as early as April 2014. It's currently set to begin on April 11, 2016.

Trial delayed for man charged in triple slaying in 2012

HAYNEVILLE, Ala. (AP) -- There's been another trial delay for a man charged with killing 9-year-old twins and a 73-year-old man in 2012.

Deandra Marquis Lee was scheduled to go on trial on Oct. 10 in the slayings of Taylor and Jordan Dejerinett and their caretaker, Jack Mac Girder.

But WSFA-TV reports that a judge has delayed the capital murder case.

Lee was also set for trial last April 10, but that was pushed back to allow for a mental evaluation. That screening determined the 27-year-old man was able stand trial in the triple killing.

The victims' bodies were discovered dumped on a dirt road off a highway in rural Lowndes County. All three people were shot to death.

Lee pleaded not guilty to the slayings in 2013. He is in jail awaiting trial.

Jury selection starts in Deandra Lee’s triple capital murder trial

    WSFA 12 News

LOWNDES COUNTY, AL (WSFA) - The trial of triple capital murder suspect Deandra Lee hasn’t started, but jury selection is underway. The trial could begin on Monday, according to the Lowndes County clerk’s office.

Lee was the target of a four-day manhunt in 2012 for the shooting deaths of twins Taylor and Jordan DeJerinett and their 73-year-old caretaker, Jack Mac Girdner. Their bodies were found in a field in Lowndes County along Alabama Highway 21.

There is an issue with the proceedings. According to the clerk, the courtroom at the Lowndes County Courthouse has been closed due to hazardous conditions. The reason? An infestation of bats.

Tuesday morning, the presiding judge entered an order that declared the courtroom, the only one in the county, closed due to the hazardous conditions.

The judge’s order calls for moving Lee’s trial, and all other courtroom business, to the Lowndes County Commission Chambers until it’s deemed safe again by the Alabama Department of Public Health. Those chambers are located in the courthouse annex.

The clerk said the courtroom is full of bats, and that it’s been a problem for years.

Late Tuesday, the Alabama Department of Public Health confirmed with WSFA 12 News that the county commission had hired an eradicator over the last week to rid the courthouse of its bat problem. The contractor has been treating for the last 4 to 5 days.

There was an issue with the proceedings earlier in the week, when the courtroom at the Lowndes County Courthouse was closed due to an infestation of bats.

Montgomery man convicted of killing 9-year-old twins and their 73-year-old caretaker

    By Howard Koplowitz
    AL.com

A Lowndes County jury convicted a Montgomery man on capital murder charges Thursday in the 2012 killings of 9-year-old twins Jordan and Taylor Dejerinett and their 73-year-old caretaker, Jack Mac Girdner.

Deandra Marquis Lee, 22, was found guilty on six capital murder charges -- three for the killings, two for killing victims under 14 years old and an additional charge for committing the murder during a robbery, according to court records.

Lee shot the victims while robbing the 73-year-old caretaker of his 1998 Mercedes Benz, which was found in Dallas County with all four doors missing. Their bodies were found on a remote road in Lowndes County after they were reported missing two days earlier in June 2012. Lee was on the lam for nearly a week before he was captured in a massive search that included the U.S. Marshals and the Alabama Bureau of Investigation.

Lee had been acquitted on capital murder and attempted murder charges in March 2011 in an unrelated 2008 shooting.

The penalty phase of Lee’s trial is scheduled for Monday.

Deandra Lee sentenced for murder of twins, caretaker

    By WFSA Staff

LOWNDES COUNTY, AL (WSFA) - The man convicted last week of killing twins and their caretaker in 2012 has been sentenced to life in prison without the possibility of parole.

Deandra Lee’s defense called witnesses who made a plea for life without parole. The jury, by an eight to four vote, decided to send him to prison for the rest of his life instead of putting him on death row.

On Thursday, Lee was found guilty of six counts of capital murder for the 2012 deaths of 9-year-old Montgomery twins Taylor and Jordan DeJerinett, as well as their 73-year-old caretaker, Jack Mac Girdner.

The victims' bodies were found on June 9 in a field along Highway 21 near the Lowndes County city of Hayneville. All three had been shot to death.

Lee was quickly developed as a suspect and a manhunt was formed to find him. Law enforcement took him into custody in Selma several days later.

Monday’s proceedings were held in the Lowndes County Commission Chambers due to a bat infestation in the courtroom.

Even in Alabama, no death penalty for that? Wow.
