    Hurley man charged with capital murder in woman's death

    JACKSON COUNTY, MS (WLOX) - A Hurley man has been charged with capital murder for the death of Frankie Taylor Fairley. The 59-year-old was found Wednesday stabbed to death in a field near her home on Polktown Road.

    A few hours after she was discovered, Scotty Lakeith Street was arrested and charged with the killing.

    Fairley went missing Tuesday night when she left her home to make a quick trip to East Central High School. She was driving a gold 2004 Honda Odyssey van, which, according to Jackson County Sheriff Mike Ezell, was used later that night in a strong armed robbery in D'Iberville.

    Street has also been charged in that robbery, and could face the death penalty, if convicted of capital murder.

    A second suspect is in custody, but has not been charged as of Thursday morning.

    PASCAGOULA, Mississippi -- Scotty Lakeith Street, the 36-year-old Hurley man accused of fatally stabbing Frankie Fairley during a robbery earlier this week, was denied bail during an initial appearance before Judge T. Larry Wilson this afternoon.

    Street, of Polktown Road, is accused of stabbing and killing Fairley on Tuesday.

    Authorities say he then took her van and used the van in an armed robbery in a D'Iberville convenience store Tuesday night.

    D'Iberville police have also charged Street in the robbery, Sheriff Mike Ezell has said.

    The incident occurred "while engaged in a felony robbery," Wilson read from the capital murder charge this afternoon. Therefore, no bail was granted.

    The body of the Hurley woman, who went missing Tuesday afternoon, was found in a field near Polktown and Davis Sawmill roads at about noon Wednesday. She and Street both lived on Polktown, authorities have said.

    A second suspect was taken into custody in connection to the murder, but that man was later cleared of any wrongdoing.

    Street did not yet have an attorney. The judge advised him of his rights and confirmed his personal information.

    When asked if he worked, Street replied, "I work whenever I can."

    A handful of family members gathered for the initial appearance.

    Street's mother fainted as she left the courtroom and burst into tears as she entered the hallway. She sat sobbing and praying as workers called Acadian Ambulance to check on her.

    She was taken to Singing River Hospital on a stretcher.

    Jackson County authorities on Wednesday morning were asking for the public's help in locating Fairley, who had been missing since about 3 p.m. Tuesday.

    "It's the worst case scenario here," the sheriff said later that day from the field where her body was found.

    The woman was last seen by her husband, when she left her home and asked her husband to watch a pot of food on the stove while she was gone.

    She was driving a gold 2004 Honda Odyssey van and was going to East Central High School, but she never made it home.

    Trial date set in capital murder of Hurley woman

    PASCAGOULA, Miss. - A Circuit Court judge has set an Aug. 22 trial date for a Hurley man accused of stabbing a woman to death during a December 2014 robbery in Jackson County.

    A Jackson County grand jury indicted Scottie Street, 37, on a charge of capital murder in the Dec. 9, 2014. He was charged in the death of Frankie Fairley, 55.

    Street pleaded not guilty. He was shackled, chained and dressed in yellow jail jumpsuit Monday, the Sun Herald reported. Street did comment on the case.

    Street is also accused of stealing Fairley's van that police say he later used in a strong arm robbery at a D'Iberville convenience store the same day as the murder.

    Fairley remains jailed without bond.

    Jury selection began Monday in the capital murder trial of a Jackson County man accused of robbing and stabbing to death a retired school teacher, wife and mother.

    Scotty LaKeith Street, 39, is accused in Dec. 9, 2014, killing of 55-year-old Frankie Fairley. If convicted, he’s facing a possible death sentence.

    Fairley was last seen by her husband when she left their home around 3 p.m. She asked her husband to watch a pot of food simmering on the stove until she returned.

    When she didn’t return home that night, her family reported her missing. Fairley was headed to East Central High School in her gold 2004 Honda Odyssey van when the alleged attack began.

    Fairley and Street both lived on Polktown Road.

    Jackson County investigators found Fairley’s body in a field near Polktown and Davis Sawmill roads a day after the robbery and killing.

    Street was taken into custody after police say he used Fairley’s van the same day of the killing to commit a strong-arm robbery at a D’Iberville convenience store.

    A graduate of East Central High School, Fairley earned her bachelor’s and master’s degrees from the University of Southern Mississippi. She was a school teacher in the Lucedale School District for 36 years before she retired, just seven months before her killing.

    She and husband, Charlie Fairley Sr., raised 13 children.

    Retired special education teacher was stabbed 37 times and left to die, prosecutors say

    PASCAGOULA - A retired Lucedale special education teacher was robbed and stabbed 37 times before she was left to die in a field less than half a mile from her home, according to a Jackson County prosecutor.

    That and other allegations in the the Dec. 9, 2014, slaying of Frankie Fairley, 55, came out Tuesday during opening arguments in the capital murder trial of Scotty LaKeith Street.

    If convicted, Street, 39, is facing a maximum sentence of death or life without parole.

    On the morning of the murder, Fairley's day started like any other, Assistant District Attorney Cherie Wade said.

    She got up, dressed her two younger children and then dropped them off at friend's house to help her decorate for Christmas.

    She later returned home and started cooking dinner for her family. She was last seen by her husband around 3 p.m. when she asked her husband to watch a pot of food simmering on the stove until she returned.

    Fairley was headed to East Central High School in her 2004 Odyssey van when she was last seen.

    By 6 o'clock that evening, her family reported her missing.

    A couple of Fairley's friends were out searching for her when they found her body in a field and alerted authorities.

    Street was taken into custody after police say he used Fairley's van the same day of the killing to commit a strong-arm robbery at a D'Iberville gas station.

    Investigators later learned Fairley stopped at a Dollar General store in the Hurley community the day of her death.

    On the store's surveillance video, both Fairley and Street are spotted in the store together. The two had known each other for years because they both lived on Polktown Road.

    According to prosecutors, investigators searched Fairley's van and found various items, including a couple of blood spots that tested positive as Fairley's blood.

    Authorities determined what Street was wearing from video surveillance of Fairley at a Dollar General store in Hurley the day of the killing.

    Prosecutors believe Fairley was trying to help Street out the day of the killing and died because her act of kindness.

    After Street's arrest, authorities searched his home, Wade said, and found the clothes he was wearing at the Dollar General dumped behind his home. The clothes had a couple of spots of blood on them.

    Street's attorney, Amanda Galle, pointed out that investigators only found a couple of specks of blood on Street’s clothing, something she called “unusual” for the amount of blood to be found on someone accused of stabbing Fairley “30-something” times.

    Investigators also never found the weapon, Galle said, and no one witnessed the killing.

    “When you leave here, you are still going to have unanswered questions about what happened between Ms. Fairley and Mr. Street,” Galle said.

    Jury to hear more evidence before deciding life or death for Scotty Street

    JACKSON COUNTY, MS (WLOX) - A Jackson County jury will hear a second day of evidence before heading back to a conference room and determining whether Scotty Street should receive the death penalty. That jury found Street guilty of capital murder in the 2014 stabbing death of Frankie Fairley, the retired special education teacher from Hurley.

    Fairley's family breathed a sigh of relief as the verdict was read. Street's family walked out of the courtroom sobbing.

    After the verdict was read, testimony started almost immediately in the sentencing portion of the trial. The jury will now decide if Street will spend the rest of his life in prison or if he will face the death penalty.

    Defense attorney's called several witnesses to the stand to talk about Street's mental state. One of Street's sisters testified their mother tried to get him help several times. She said Street would talk to himself when he wasn't taking his medication and used recreational drugs at one point.

    Another sister testified, describing Street's behavior growing up as "erratic."

    "Scotty's had a lot of mental issues," she said. "Scotty's been institutionalized so much, it's beyond my count."

    A mental health professional who treated Street at Singing River Health System was also called to the stand. She told the court she had to give Street injections every few weeks for his mental illness. She said Street suffered from schizophrenia and needed to be in a group home with a caregiver.

    Court will resume at 8:00 a.m. Thursday.

    According to autopsy results revealed in court Tuesday, Street stabbed Fairley 37 times. He then stole Fairley’s van and drove to D’Iberville, where he reportedly robbed a convenience store.

    The district attorney’s main argument in this case focused on circumstantial evidence, like the time line of events on Dec. 9, 2014 leading up to the discovery of Fairley's body, video evidence showing Street and Fairley in the same store, Fairley's blood found on Street’s discarded clothing, and the fact that Street committed an armed robbery that same night in Fairley's van.

    "The verdict is overwhelmingly clear," District Attorney Tony Lawrence told the jury before deliberations.

    JACKSON COUNTY, MS (WLOX) - The same Jackson County jury which convicted 39-year-old Scotty Street for the brutal stabbing death of retired teacher Frankie Fairley, failed to reach a unanimous verdict on the death penalty Thursday afternoon.

    Judge Kathy King Jackson sentenced Street to life in prison without parole
    . The defendant's long history of severe mental illness was a factor in the jury sparing his life.

    Testimony from two psychiatrists outlined Street's ongoing paranoid thinking and bizarre behaviors.

    “Place trash bags on his head to keep his brain from frying. He was hearing children in his air conditioner, that he thought had somehow gotten in there,” said forensic psychiatrist, Dr. John Montgomery.

    District attorney Tony Lawrence conceded he mental illness, but told the jury Street still knew right from wrong when he stabbed Fairley repeatedly before dumping her in a field to die.

    “And then she receives 36 more times, that metal object going into her body,” he told the jury.

    Defense attorney Kelsey Rushing focused on the defendant's chronic mental health troubles. He says without that, they wouldn’t be here today.

    “If you believe what you convicted him of, has something to do with what was happening in his brain, then you should come back with a sentence of life,” Rushing told the jury.

    After deliberating for some three hours, the jury could not reach a unanimous decision on the death penalty, leaving Judge Kathy Jackson the only other option - life without parole.

    “I think the family is glad they finally got to hear a jury render a verdict of guilty for capital murder. They've been waiting for three years now for this, and I think they're glad it's done,” said Lawrence.

    Asked if he had any comment before he was sentenced, Street told the judge he apologized and feels bad about what happened.

    "I'm just asking for mercy," said Street.
